Burden of Proof


In criminal cases, it is the responsibility of the Crown (the prosecutor) to prove beyond a reasonable doubt that the accused is guilty of committing the crime. The defense (lawyer for the accused) does not have to prove that the accused is innocent. The responsibility of proving guilt lies totally with the Crown.
